Operator Terms of Service
Effective date: September 26, 2026
These Terms govern your organization’s use of Manage My Range, our app for range operators, and the web dashboard at app.mapmyrange.com (together, the “Operator Service”). They are an agreement between Windegrated Solutions, LLC (“we”, “us”) and the organization whose driving range you run.
Section 13 makes your organization responsible for claims that arise from its range, what it publishes, its outreach and its people, and section 14 requires binding arbitration. Please read both before your organization relies on the Operator Service.
If you are a golfer, this is the wrong page. The golfer app, Map My Range, is governed by our Terms of Service.
1. Acceptance, and who is agreeing
By accessing or using the Operator Service, you agree to these Terms. If you do not agree, do not use it.
You are almost certainly using it on behalf of an organization — the business that owns or runs the range. You represent that you have authority to bind that organization to these Terms, and “you” in this document means both you and that organization. Access to the Operator Service is granted by invitation, so somebody at your organization has already accepted these Terms on its behalf.
2. Licence
Subject to these Terms, we grant your organization a limited, non-exclusive, non-transferable, revocable licence to use the Operator Service to run its own driving ranges. That licence is granted to you personally as one of the organization’s people, and it lasts only as long as the organization gives you access.
You may not resell, sublicense, or provide the Operator Service to a range your organization does not own or operate. We reserve all rights not expressly granted.
3. Accounts and your team
Access is granted, not self-serve. An administrator at your organization invites people, decides what each may do, and can revoke that access at any time. Consequently:
- You are responsible for who holds access to your range, and for revoking it promptly when somebody leaves.
- You are responsible for activity under your account and for keeping your credentials confidential. Authentication is provided by Clerk on our behalf.
- There is no Delete Account screen in Manage My Range, because an operator account is not one you created. Ask your administrator to remove your access, or email support@mapmyrange.com to have the account itself closed, and your personal data erased from it if you ask. Our Delete Your Account page sets out both routes.
4. Your range’s information, and what golfers see
Most of what you enter is meant to be published. Your range’s name, location, opening hours, closures, holidays, events and target positions are shown to golfers in the Map My Range app. That is the purpose of the product.
- You grant us the right to display that information to golfers and on our website, for as long as you use the Operator Service, and after that inside golfers’ own practice history, as section 16 describes. You keep ownership of it.
- You are responsible for its accuracy. Golfers rely on your hours and your target positions. If a target moves and the app still shows the old spot, the distances a golfer sees will be wrong, and we have no way to know that from here.
- You are responsible for having the right to publish it — that you own or are licensed to use any name, description or imagery you enter.
- Do not enter personal data about golfers or staff into free-text fields. Those fields are for describing a facility.
5. Data protection, and outreach in particular
Our Operator Privacy Policy sets out what we collect and why. This section is the part that binds the two of us.
We are the controller of operator account data. Windegrated Solutions, LLC determines why and how the personal data of your people is processed, as described in that policy, and is responsible for it.
For the ordinary running of the Operator Service, neither party is the other’s processor. You do not process personal data on our instructions and we do not process it on yours, so neither party owes the other a processing agreement under Article 28 of the UK or EU GDPR.
Outreach is the exception, and for it we are joint controllers. If your organization uses outreach, you determine which pseudonymous golfers receive a campaign and what it says, and we determine how an audience is resolved, how a message is delivered, and which consents, frequency caps and quiet hours apply. For that processing, and only that processing, the parties are joint controllers within the meaning of Article 26, and responsibility is allocated as follows:
- We are responsible for all information given to golfers, for obtaining and recording their consent, for enforcing frequency caps and quiet hours, for providing the means to opt out, and for answering every request a golfer makes under Articles 15 to 22. We are the single point of contact for golfers for that purpose, at privacy@mapmyrange.com.
- You are responsible for the lawfulness, accuracy and honesty of the content of each campaign your organization starts, for honouring any offer it makes, and for using outreach only to market a facility your organization owns or operates.
- We hold the identities behind the aliases. Your organization is not given them; you will not attempt to re-identify a golfer from an alias or from anything else the Operator Service shows you, and you will not combine that data with another source in order to do so.
- We are responsible for notifying supervisory authorities and affected golfers of a personal-data breach affecting outreach data. You will tell us without undue delay if you become aware of one.
- A golfer may exercise their rights against either party. If a golfer approaches you, you will direct them to us and tell us it happened.
The essence of this arrangement is published in the Operator Privacy Policy, as Article 26(2) requires.
If we ever process personal data on your instructions — which the Operator Service does not do today — we will put an Article 28 processing agreement in place before we begin.
6. The Operator Service is not a safety system
The Operator Service helps you publish that a range or a surface is closed. It does not close anything, stop anybody hitting, or control equipment. Do not rely on it as a safety control, an access control, or a substitute for signage, supervision or your own operating procedures. Distance and elevation figures are estimates and are not survey-grade. Your organization remains solely responsible for the safety of its range and of everyone on it.
7. Acceptable use
You agree that you will not:
- Reverse engineer, decompile, or attempt to derive the source code of the Operator Service, except where such restriction is prohibited by law.
- Scrape, harvest, or systematically collect data from the Operator Service, or access it through any automated means not provided by us.
- Interfere with, disrupt, or tamper with range sensors, hardware, or the integrity of the Operator Service.
- Use it to publish information about a range your organization does not own or operate.
- Use it to violate any law or infringe anyone’s rights.
8. Early access
The Operator Service is in early access. Features may change, be added, or be withdrawn, and we may work alongside you to set your range up. We will give reasonable notice of a change that materially reduces functionality you rely on.
9. Fees
Paid plans. Some capabilities of the Operator Service, such as outreach, are available only on a paid plan. If your organization buys a plan, the plan, its price, its billing period and anything else agreed are set out in the order, quote or checkout page your organization accepts (an “Order”), which forms part of these Terms. If an Order conflicts with these Terms, the Order governs that plan.
Payment. Unless an Order says otherwise, fees are billed in advance for each billing period, are due within 30 days of the invoice date or at checkout, and are non-refundable except where the law or the Order requires otherwise. Fees exclude taxes, which your organization is responsible for, apart from taxes on our income.
Renewal and price changes. Unless an Order says otherwise, a plan renews automatically for the same billing period unless either party gives notice before the current period ends. We will give at least 30 days’ notice of a price increase before it applies to a renewal.
Late payment. If a payment is overdue, we may suspend paid capabilities, after giving notice, until it is paid.
10. Feedback
If your organization or its people send us suggestions, ideas or other feedback about the Operator Service — including while we work alongside you to set a range up — you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use it for any purpose, without any obligation or payment to you.
11. Disclaimer of warranties
THE OPERATOR SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that distance measurements, elevation figures, or published hours are accurate, or that the Operator Service will be uninterrupted or error-free. You use it at your own risk.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WINDEGRATED SOLUTIONS, LLC AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE OPERATOR SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNT YOUR ORGANIZATION PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR USD $50.
Nothing in these Terms limits liability that the law does not allow to be limited. This section limits our liability only; it does not limit your organization’s obligations under section 13.
13. Indemnity
Your organization’s indemnity. Your organization will defend, indemnify and hold harmless Windegrated Solutions, LLC and its members, managers, officers, employees, contractors and agents (together, the “Windegrated Parties”) from and against any claim, demand, suit, regulatory inquiry or proceeding brought by a third party, and any resulting liabilities, damages, losses, judgments, settlements, fines, penalties, costs and expenses, including reasonable attorneys’ and experts’ fees, to the extent arising out of or relating to:
- Your range and its operation — the ownership, condition, operation or supervision of any range or facility your organization runs, including bodily injury, death or damage to property suffered there by golfers, staff or anyone else;
- What your organization publishes — anything your organization or its people enter into or publish through the Operator Service, including range names, addresses, hours, closures, holidays, events, target positions and descriptions, and any claim that it is inaccurate, out of date or misleading, or infringes anyone’s rights. This includes a claim alleging that information shown by the Operator Service or the golfer app contributed to an injury or loss, where that information was entered, or left unchanged, by your organization or its people;
- Outreach your organization starts — the content of any campaign, any offer it makes, and any claim under advertising, marketing, consumer-protection or anti-spam law arising from that content;
- Your people — the acts and omissions of anyone your organization gives access to, including access it fails to revoke;
- Data protection — your organization’s breach of section 5, including any attempt to re-identify a golfer, and any fine or penalty imposed as a result; and
- Breach and law — your organization’s breach of these Terms, or its violation of any law.
Procedure. We will tell your organization promptly about a claim we believe this section covers; a delay relieves your organization of its obligations only to the extent the delay prejudices its defence. We may choose to control the defence and settlement of the claim ourselves, at your organization’s expense, or to let your organization control it with counsel reasonably acceptable to us, in which case we may take part with counsel of our own, at our own expense. Either way, the other party will cooperate, at the defending party’s reasonable expense. Your organization may not settle a claim in a way that admits fault on our part or imposes any obligation on us without our prior written consent.
Scope. This section does not cover a claim to the extent it was caused by our own gross negligence or wilful misconduct. Your organization’s obligations under this section are not subject to any limitation of liability in these Terms, and they survive termination.
14. Dispute resolution: binding arbitration and class-action waiver
Please read this section carefully — it affects how disputes are resolved.
Informal resolution first. Before starting an arbitration or a court case, the party with a dispute must send the other a written notice describing it — to us at support@mapmyrange.com, and to your organization at the email address of one of its administrators — and both parties will then try in good faith to resolve it for 30 days after the notice is received.
Agreement to arbitrate. Any dispute arising out of or relating to these Terms or the Operator Service will be resolved by binding arbitration on an individual basis, rather than in court, administered by the American Arbitration Association under its Commercial Arbitration Rules then in effect, before a single arbitrator. The arbitration is seated in Delaware, and hearings may be held by video. Either party may instead bring an individual claim in small-claims court if it qualifies, and either party may ask a court for an injunction or other interim relief to protect its intellectual property or confidential information, to prevent irreparable harm, or to enforce section 5. The Federal Arbitration Act governs the interpretation and enforcement of this section, and judgment on an award may be entered in any court with jurisdiction.
Class-action waiver. You and Windegrated Solutions, LLC agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one party’s claims.
If part of this section fails. If a court decides that the class-action waiver cannot be enforced for a particular claim, that claim must be brought in court under section 15, and the rest of this section continues to apply.
15. Governing law and courts
These Terms, and any dispute arising out of or relating to them or the Operator Service, are governed by the laws of the State of Delaware, without regard to its conflict-of-law principles, except that the Federal Arbitration Act governs section 14. Any dispute that is not arbitrated will be heard only in the state or federal courts located in Delaware, and both parties consent to their jurisdiction.
16. Termination
Your organization may stop using the Operator Service at any time. We may suspend or terminate access if these Terms are violated, if a payment is overdue after notice, if the law requires us to, if it is necessary to protect the Operator Service, golfers or others, or if we discontinue the Operator Service.
If your organization stops using it, the range information you published stops being shown to golfers, with one exception. A golfer who practised at your range keeps their practice history, and that history goes on showing your range’s name and its targets, with where they stood, as they were when your organization left. It shows them only to that golfer, and only for as long as the golfer keeps that history. Sections that by their nature should survive termination — including content licences already exercised, the licence in section 4 for golfers’ practice history, indemnity, disclaimers, limitation of liability, and dispute resolution — will survive.
17. Changes to these terms
We may update these Terms from time to time. When we do, we will revise the effective date above. If a change is material, we will also tell your organization’s administrators, by email or in the Operator Service, before it takes effect, giving at least 30 days’ notice unless the change is needed sooner for legal, security or safety reasons. Continued use of the Operator Service after changes take effect constitutes acceptance of the updated Terms. A change to section 14 does not apply to a dispute of which either party gave notice before the change took effect.
18. Apple App Store
If Manage My Range was downloaded from the Apple App Store, the following also applies to its use:
- These Terms are between your organization and Windegrated Solutions, LLC, not Apple. We, not Apple, are solely responsible for the app and its content.
- The licence to use the app is limited to a non-transferable licence to use it on Apple-branded products owned or controlled by you or your organization, as permitted by the Usage Rules in Apple’s Media Services Terms and Conditions, except that it may also be used by other accounts associated with the purchaser through Family Sharing or volume purchasing.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for the app. To the maximum extent permitted by law, Apple has no other warranty obligation for the app, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our responsibility, to the extent these Terms do not disclaim them.
- We, not Apple, are responsible for addressing any claims relating to the app or its possession or use, including product-liability claims, claims that the app fails to conform to a legal or regulatory requirement, and claims under consumer-protection, privacy or similar laws.
- If a third party claims that the app, or its possession or use, infringes their intellectual-property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- You must comply with any applicable third-party terms when using the app, such as your wireless data service agreement.
- Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept them, Apple has the right, and is deemed to have accepted the right, to enforce them against you as a third-party beneficiary.
- Questions, complaints or claims about the app should be sent to us, at support@mapmyrange.com.
19. General
- Entire agreement. These Terms, together with any Order, are the entire agreement between your organization and us about the Operator Service, and they replace any earlier agreement about it. Our Operator Privacy Policy explains how we handle personal data; it is a notice rather than part of these Terms, and section 5 is the binding arrangement between us.
- Severability. If any provision of these Terms is found invalid or unenforceable, it will be limited or removed to the minimum extent necessary, and the rest of these Terms remains in full force.
- No waiver. If we do not enforce a provision, we have not waived our right to enforce it later.
- Assignment. Your organization may not assign or transfer these Terms without our written consent. We may assign them, in whole or in part, including in connection with a merger, acquisition, reorganization or sale of assets.
- Notices. We may give notices to your organization’s administrators by email, in the Operator Service, or by posting them here. Your organization may give us notice at support@mapmyrange.com.
- Independent parties. The parties are independent contractors. Nothing in these Terms creates a partnership, joint venture, agency or employment relationship, and neither party may bind the other. Being joint controllers for outreach under section 5 does not change this.
- Events beyond our control. We are not liable for any delay or failure to perform caused by events beyond our reasonable control.
- No other beneficiaries. Apart from Apple, as section 18 describes, these Terms do not give anyone else any rights.
